Biography

Carlos is the founding and managing partner of Calderon & De La Sierra and has devoted his professional life to Intellectual Property.

While his principal activities have traditionally encompassed litigation and enforcement of Intellectual Property Rights, he has also been active in counseling, prosecution, searches and strategy for both patents and trademarks.

He frequently lectures in Mexico and abroad on a wide range of Intellectual Property Issues, and has actively collaborated with the Mexican Patent and Trademark Office and in professional associations involving Intellectual Property in legislative efforts and educational events pertaining to Intellectual Property Issues.

Carlos is a professor of Patent Law and Intellectual Property Law for post-graduate courses at Instituto Tecnológico Autónomo de México (ITAM) and has been a visiting professor of Intellectual Property at the University of California and at Universidad Anáhuac in Mexico City.

Biography

Carlos heads the Trademark Department at Calderón y De La Sierra. Prior to joining Calderon y De La Sierra, Carlos worked at one of the most recognized Intellectual Property Firms in Mexico. Additionally, he worked at the National Banking and Securities Commission (CNBV) and at one of the most prestigious brokerage firms.

He joined the Firm in 2004 and was named Partner in 2012. His practice focuses mainly on all aspects of trademark law, including prosecution, counseling and enforcement. Throughout his professional career, he has obtained several trademark registrations for national and international companies, successfully overcoming trademark refusals by the authority, for several trademarks applied to a wide range of goods and services. He has successfully conducted Cancellation, Infringement and Invalidity Proceedings before the Mexican Institute of Industrial Property.

Additionally, he has drafted and responded to numerous “Cease and Desist” letters related to alleged trademark infringement, as well as negotiated and drafted trademark license agreements, with the aim of maximizing client value in this regard.

Carlos has extensive experience in managing intellectual property portfolios and licensing matters.

Mariel is a Partner with Calderon & De La Sierra since January 2016 and co-heads the Trademarks and Copyrights Department. She has devoted her practice on Intellectual Property since 2001.

Prior to joining the Firm, her professional career includes her participation as an associate and partner in three of the most important Law Firms in Mexico, internationally recognized in intellectual property matters.

Mariel has considerable experience in managing trademark portfolios of domestic and foreign clients, advising business owners of well-known distinctive signs, among others, including the devising and developing strategies and negotiations towards to protect and maintain such rights. She is also experienced on issues pertaining to the protection and enforcement of IP rights in the different array of procedures tried with the Mexican Copyright Office.

She as well has a wealth of experience in administrative litigation, involving nullity and cancellation actions, and as well as infringement proceedings tried with the Mexican Trademark Office and the resulting appeals at all levels of the judiciary. Mariel has provided advice to a diverse national and foreign clientele aimed to protect their trademark rights, participating in the analysis and audits of large portfolios of Intellectual Property Rights, and has handled domestic and worldwide projects for the licensing, franchise, as well as the security of such rights.

Biography

Paloma is a Partner with Calderon & De La Sierra since January 2016 and co-heads the Trademarks and Copyrights Department. Prior to joining the Firm, she worked for two of the most recognized IP Law Firms in Mexico, leading and heading the Copyrights division.

She has focused her practice on Intellectual Property Law and Litigation since 2001. Since then, she has also led the Copyright Department of the most important and recognized law firms in Mexico and Spain. Throughout her practice, she has been able to advise major companies from Mexico and abroad with a focus on protecting their IP interests while fostering growth in their businesses. Paloma also frequently drafts and negotiates intellectual property agreements and advises on entertainment law, advertising and promotional materials.

During 2009 and 2010, Paloma joined a well-known and recognized Law Firm specialized in Copyrights in Spain as an international senior associate while studying her LL.M in Copyrights, New Technologies, Information Society and Data Protection in Universidad Carlos III de Madrid (Campus Getafe). During this period, Paloma advised major international clients in the field of arts and entertainment while actively collaborated with the team of lawyers responsible for drafting the new Intellectual Property Law for the Principality of Andorra.

Paloma advises clients on the creation of top level legal strategies aimed to protect and enforce their Intellectual Property Rights, yet her practice is primarily focused on Copyrights and neighboring rights, entertainment law and image rights. She is an expert being in preparing, devising and assessing all kinds of agreements and strategies pertaining to these matters.

Biography

In 2002 he founded the firm Merino y Maille, and in 2020 he joined Calderon y de la Sierra.

Miguel Angel has represented for more than 15 years the main software development companies in the world, with which he has initiated more than 3,000 litigation processes on defense and protection of their intellectual property rights.

His experience is mainly focused on industrial property and intellectual property litigation issues. He has advised companies in the food industry, service providers, musical groups and writers, on the protection of their intellectual property.

For two consecutive years he was a member of the Editorial Board of Contraband and Piracy of Reforma Newspaper, and he has offered various conferences at the Mexican Association for the Protection of Intellectual Property, Instituto Tecnologico de Monterrey and Universidad La Salle. Cesar is a Partner at Calderon & De la Sierra and is the head of the Patent Department.

He was a partner in Olivares from 1998 to 2015, where he acted as the managing partner for the Patent practice group and worked for Telmex, one of the largest telephone and Internet companies in the world, and Monsanto, a global provider of technologies and products for the automotive industry and agriculture. His profound technical knowledge of the telecommunications, software and automotive markets coupled with his advanced degree in Engineering positions him as an excellent resource for his clients.

He has represented some of the leading innovator companies in the world as he focuses his practice in the areas of telecommunications, electronics, software, energy, diagnostic and medical devices, consumer products and pharmaceuticals. His practice is primarily in the area of patent prosecution, but he frequently serves as a technical advisor in litigation support as he brings expert level understanding of patents.

Since 1995, Alberto HUERTA BLECK has focused his practice on IP law and litigation. His practice involves civil procedures, constitutional procedures (Amparo) and administrative litigation, including patent, trademark and copyrights cancellation and infringement / enforcement actions.

Mr. HUERTA BLECK has been involved in civil proceedings relating to lost profits and damages; patent litigations; criminal and enforcement proceedings; administrative litigation in which the judges recognized the “Well Known” status of different famous trademarks. Mr. HUERTA BLECK has obtained favorable resolutions relating to false advertising or non-authorized use of a person’s picture and was successfully involved in the first case of ambush marketing ruled in Mexico in 2016, among numerous other administrative IP and constitutional proceedings.ambush marketing”.

Biography

Alejandro is a partner with Calderon y de la Sierra and is the head of the Corporate and Commercial Law practice in the firm since 2016.

With more than 30 years in the practice of law, he is experienced at providing advice to national and international clients on corporate-related matters, including the incorporation of companies, its corporate planning and relationships among the shareholders; mergers, spin-offs, acquisitions and joint-ventures, planning and execution of private placements and secularization.

He also has extensive experience in contractual negotiations, international transactions and international contracts, including negotiation and preparation of credit agreements, formation of venture capital, trusts and various types of financing.

Within his professional activity, he advises clients in the implementation of rules and schemes of corporate governance, business ethics and anti-corruption.

In the field of intellectual property practice, he has extensive experience and regularly participates in matters concerning trademarks, copyrights and information technologies; As well as the drafting and negotiation of licensing agreements, the development of franchises, including the selection of appropriate corporate structures for the acquisition and granting of franchises.

In addition to having received his Law Degree from Universidad La Salle, he attended Universidad Panamericana, where he majored in Business Law. He also graduated from the Instituto Panamericano de Alta Dirección de Empresas (IPADE) with a program in High Business Direction.

Alejandro has been lecturer at the Graduate Diploma in International Trade offered by the Escuela Libre de Derecho in coordination with the International Chamber of Commerce (ICC); professor of Business Law at Universidad La Salle; professor of Foreign Investment Law at Universidad Anáhuac del Sur; and professor of Intellectual Property and Foreign Investment Law at CETYS Universidad in Mexicali, B.C., México.

Biography

Efrén Del Olmo Haro joined Calderon & De la Sierra in 2016 as an intern in the trademark area, where he specialized in the prosecution of intellectual property matters, managing since then several national and international portfolios. Then, in 2017, he started his practice as an intern in the litigation area where he has focused on complex patent matters pertaining to the biotechnology and pharmaceutical fields, as well as in the handling of various contentious proceedings in trademark and patent matters.

Subsequently, in 2019 he concluded his Law Degree at Universidad LaSalle, from which he graduated with the National Award for Excellence Performance EGEL – CENEVAL, a distinction received by only 2% of law students nationwide, and since then he has served as a lawyer in the litigation department of Calderon & De la Sierra, where his practice has focused on the advice and preparation of strategies for the protection, defense and enforcement of intellectual property rights, mainly in trademark and patent matters.

Ana Cecilia is a member of the Patent Department.

She joined Calderon & De La Sierra in 1998. She focuses her professional practice in matters related to patent drafting, technical searches, and patent office actions regarding national and PCT procedures.

She mainly handles patent matters in the chemical, pharmaceutical, and biotechnological industries.

Prior to entering Calderon & De La Sierra, Ana Cecilia worked at one of the most recognized intellectual property law firms in Mexico, as well as several national companies and laboratories.

Biography

Gerardo Daniel Martínez Yañez joined Calderón & De la Sierra in 2018 as an intern in the litigation department, handling contentious matters related to patents and trademarks.

Before joining the Firm, Gerardo Martínez gained professional experience as an intern at one of Mexico's leading firms, internationally renowned for its expertise in Information and Communications Technology (ICT) & Fintech.

In 2021, he completed his Bachelor's Degree in Law at the Universidad Iberoamericana, and currently serves as an associate in Calderón & De la Sierra's litigation department. His practice involves advising on strategies for the protection, enforcement, defense, and exercise of intellectual property rights, mainly in the areas of trademarks and patents (pharmaceuticals and biotechnology).

In regulatory matters, his services include formal and technical opinion drafting, obtaining permits and authorizations, conducting due process audits, developing projects and subproducts, designing and implementing regulatory strategies, advising on product labeling and advertising campaigns, as well as managing government relations with relevant authorities, including the Federal Commission for the Protection against Sanitary Risks (COFEPRIS) and other competent authorities in consumer protection, animal and plant health.

He has experience in consultancy regarding Information and Communication Technologies (ICT) and Copyright.

Biography
